Nairobi businessman Jackson Kiplimo Chebet has come forward to defend his acquisition of the contested Dari property along Ngong Road, previously linked to former Cabinet Secretary Raphael Tuju.
Chebet, through his company Ultra Eureka Limited, insists the property was lawfully purchased at a public auction in October 2024 for KSh 450 million.
He says the transaction followed due legal process and that his company is now the rightful owner.
In an affidavit filed in court, Chebet dismissed Tuju’s claims as baseless, referring to them as a “mirage.” He stated that once the property was transferred and charged to Kenya Commercial Bank (KCB), any previous rights the plaintiffs held were extinguished.
“The plaintiffs’ rights to the subject property have since been extinguished. Their claims under Article 40 of the Constitution are now a mirage,” Chebet noted in the affidavit.
Chebet emphasized that Ultra Eureka Limited participated as a bona fide purchaser for value, unaware of any alleged irregularities.
He urged the court to uphold the sale, arguing that overturning it could compromise public auction integrity and create uncertainty in the property market.
He further described an incident on March 10, 2026, when his company secured Lavington Security Ltd to guard the property.
Chebet claimed over 50 men allegedly linked to Tuju attempted to block access, injuring several security personnel.
Police later intervened to restore order, and both parties were asked to present their ownership documents at Langata Police Station.
Chebet firmly rejected fraud allegations, asserting that the auction and subsequent transfer were conducted lawfully.
He warned that any attempt to invalidate the sale would unfairly prejudice his company, which has since charged the property to KCB.
The ongoing case, filed under HCCOMSU No. E636 of 2024, seeks to challenge the legality of the auction and property transfer.
Chebet maintains that upholding the sale is crucial for protecting both legal property rights and the credibility of public auctions in Kenya.
