Confusion and tension had surrounded the upcoming Banissa by-election after a voter went to court to block the polls, claiming that Ahmed Maalim Hassan, the United Democratic Alliance (UDA) candidate, held dual citizenship.
However, the High Court has now dismissed the petition, allowing the election to proceed as planned.
In a ruling delivered on Thursday, October 30, 2025, Justice Lawrence Mugambi declined to issue conservatory orders that would have stopped the Independent Electoral and Boundaries Commission (IEBC) from conducting the by-election.

The judge stated that the petition and its accompanying application would instead be heard together at a later date but emphasized that the electoral process should not be delayed.
The petitioner had accused Ahmed Hassan of holding both Kenyan and British citizenship, arguing that this made him ineligible to contest under Kenyan law.

According to court documents, Hassan’s Kenyan passport reportedly expired in 2012, while the British one listed him under a different name and as a Somali national born in Qoryoley, Lower Shabelle region, Somalia.
However, the IEBC dismissed these claims as false, insisting that Hassan met all legal requirements for candidacy. The Commission described the allegations as “a deliberate attempt to mislead and disrupt the electoral process.”
Ahmed Maalim Hassan, who is the brother to the late Banissa MP Kullow Maalim Hassan, has received overwhelming support from residents eager to see him continue his brother’s development agenda.
