Former deputy president Rigathi Gachagua Breaks his silence for the first time since the high court upheld his impeachment case as he is set to address the nation today where his speech is expected to address a number of issues following the yesterday's court ruling.
Gachagua is expected to clear the air on whether he has accepted the high court ruling or will move to the court of appeal to appeal the yesterday's ruling against his impeachment which was upheld by the high court.
Gachagua is also expected to address such issues like the 50M compensation rewarded to him by the high court for the infringement of his rights during the impeachment process in the senate.
He questioned how a process found to be constitutionally flawed could still produce a valid outcome, noting that this tension may require appellate clarification.
Otieno further warned that the judgment leaves uncertainty on the legal consequences of the impeachment, particularly regarding whether constitutional defects identified by the court should affect the final outcome.
He argued that such inconsistencies risk prolonging the dispute rather than resolving it.
The High Court ruling delivered by a three-judge bench upheld Gachagua’s impeachment but awarded him KSh50 million in damages for violation of his rights during Senate proceedings.
The court found that while the impeachment process largely met constitutional thresholds, aspects of it—particularly the refusal to adjourn proceedings to accommodate the former DP—breached fair hearing standards.
Legal analysts have since indicated that the matter is likely to proceed to the Court of Appeal, with both sides expected to file challenges and cross-appeals as the constitutional debate deepens.
As the case moves toward the next legal stage, Otieno maintains that the judgment has not settled the matter, but instead opened new constitutional questions that could shape future impeachment jurisprudence in Kenya.
